The terms and conditions below constitute a contract governing the use of the website and the purchase of any goods from the OLLY BOUTIQUE website.

3. Price
 
Prices are given in Euros, all taxes are included. The prices are those in effect on the day of ordering. They include the VAT applicable on the day of ordering. All changes in the VAT rate will be automatically reflected in the prices. The prices of our products do not include the handling costs or the delivery of the orders. For all deliveries outside the European Community, the Customer is responsible for all custom’s taxes and formalities, these are at the Customer’s expense, and it is for the Customer except when indicated otherwise, to verify that the importation of the articles ordered is authorized.

5. Payment Method

By credit card: The validation of the order by giving the credit card number and expiry date commits the Customer to paying the totality of the order. For more information on internet payment security see section 13 of the General Conditions of Sale below.

By checks: Payments can be made by cheque in Euros, established by a French bank, and made payable to OLLY BOUTIQUE. Please write your order number and address on the back of the cheque and send your payment to OLLY BOUTIQUE. The order will be accepted and processed only once the cheque has been received.

6. Confirmation

The following contractual information will be sent in an E-mail confirmation once the Customer’s order has been processed:

• unique order number
• total amount of the order, the price and the amount of delivery fees
• payment method chosen by the client
• delivery address
• customer service email address for complaints

7. Execution

The order duly accepted by OLLY BOUTIQUE according to the conditions given in paragraph 4 of these General Conditions of Sale, will be executed in no more than 7 days. In the event of out of stock, the Customer will be informed as soon as possible and will have the right to cancel his/her order. He/she will then have the right to ask either for the exchange of the product, or for a reimbursement of the sums paid within 30 days, to be counted from the day of request

8. Delivery

All orders will be delivered in a sealed, solid and discrete package, to the address given by the Customer. Only the orders which have been paid for will be delivered. In addition, OLLY BOUTIQUE reserves the right to refuse all orders from a Customer with whom litigation exists. On delivery, the Customer is bound to verify the state of the packaging and the merchandise and to E-mail or by Fax., within 3 days, any damage to the transporter and to customer services at OLLY BOUTIQUE.

- France Metropolitan : 6 € (Colissimo suivi, la Poste)
- Europe : 12 € (European Union and Switzerland, Gibraltar, Liechtenstein, San Marino et Vatican)

Certain legislations restrict the import of erotic objects. Please verify the legislation in effect in your country before ordering on the site. Customs taxes or import duties are due as soon as the parcel arrives in its country of destination. You must settle all supplementary taxes due when passing through customs. We have no control over these taxes and cannot estimate its costs, customs policies vary a great deal from one country to another. Please contact your local customs service for more detailed information.

10. Warranty

In event that the delivered product is an incorrect order, damaged or not operating, the customer should inform the OLLY BOUTIQUE customer service by e-mail or fax + 33 (0)4 78 30 89 63.  The customer service agent will try to resolve the problem in the most effective and efficient manner.  Whatever the situation, OLLY BOUTIQUE takes upon itself, with regards to the customer, the responsibility of delivering products that respect the legislation in effect, and consequently guarantees the protection of the Customer against all complaints or claims, legal or amicable, resulting from any damage caused to goods or to people by the above mentioned products. OLLY BOUTIQUE also guarantees, in accordance with the legislation in effect, the Customer against any hidden faults concerning the product delivered which renders them unfit for usage, as well as any prejudicial consequences which might thereby occur.

11. Privacy Rights

The information requested about the Customer is needed to process his order and will not be communicated to a third party. It will only be used within the company to process the order and to reinforce and personalize the communication and the offer made reserved to customers. In accordance with the French law ‘Informatique et libertés” of 6 January 1978, the Customer has the right to refuse such communication and has the right to access, to modify, to rectify and to suppress any and all personal information concerning the customer. For that, it suffices to make the request on-line or by mail, giving your surname, first name, address and if possible your customer reference number to contact@ollyboutique.com. This computerized processing of nominative data has been declared to the CNIL. This paragraph can not prevent the complete assignment of the company or the transfer of its activities to a third party.

12. Security

OLLY BOUTIQUE guarantees the ways and presentations of cryptology used to secure the transactions have been declared in application of the actual legislation. OLLY BOUTIQUE uses Sogenactif which is a secured payment method approved by Societe Generale.

13. Electronic Signature - Proof

The validation of an order associated with the authentication procedures and the protection of the integrity of messages constitutes an electronic signature having between the different parties the same value as a hand-written signature. The computer files, stored in the computer systems of OLLY BOUTIQUE with reasonable conditions of security, will be considered as proof, as communication, as orders and payments that have been carried out between the parties. The storing of orders and invoices is made on reliable material and in an irreversible manner that constitutes a true and durable copy, in accordance with article 1348 of the Civil Law.

14. Intellectual Propriety

All texts, commentaries, works, illustrations and images reproduced on the sites edited by OLLY BOUTIQUE are protected by the author’s rights as well as being their intellectual property throughout the whole world. In this respect and in accordance with the Intellectual Property Law, only private usage under certain conditions and those more restrictive than those covered by the Intellectual Property law is allowed. Any other usage is considered as counterfeiting and will be penalized under the Intellectual Property Law unless prior written authorization has been given by OLLY BOUTIQUE. Any complete or partial reproduction of the OLLY BOUTIQUE sites is strictly forbidden.

15. Contract Integrality

If, for any reason, one of the conditions of the present contract becomes inapplicable, this inapplicability will not effect the enforcement of the other paragraphs of the general conditions. The paragraph that can no longer be enforced will be replaced by another that resembles it as closely as possible.

16. Responsibility

Neither OLLY BOUTIQUE, nor the Customer, will be held responsible for any non-performance due to circumstances beyond our control, which may be, yet not exclusively, in the case of war, a public disturbance, an uprising, the disruption of public transport services, problems relating to import or export, strikes, shortage, fire, earthquakes, storms or flooding. The Customer is solely responsible for his/her choice of products, their conservation and their usage by herself/himself or a third party.

17. Litigation

The language of the contract is in French. The contract is subjected to the French Law. Any litigation will be dealt with by the courts of Lyon.
